The Action of Mortgage Foreclosure will continue unless you take action to stop it.

        Even though your lender may have filed an Action of Mortgage Foreclosure against your home, you still may be able to stop the foreclosure action.

        We urge you to contact your own attorney for legal advice; we are not permitted under the Rules of Professional Conduct to provide legal advice to an unrepresented party. For referrals to a qualified attorney call the Bar Association in your county and they may be able to refer you to an attorney.

        Call your lender and ask to speak to someone about Loss Mitigation or Home Retention Options. Please see the previous page for contact information. 

        Call the Consumer Credit Counseling Agency of the Delaware Valley at 1-800-989-2227 for free counseling. This is an independent counseling agency that may be able to assist you.

        Visit the HUD's website www.hud.gov for Help for Homeowners Facing the Loss of Their Homes.

Workout Package Available Here:

        A lender workout package consists of a financial form and written proposal. To print a financial form that lenders generally require prior to considering any loan workout request click here:  Financial Form (Word)                Financial Form (PDF)

        If you cannot reach your lender to make a proposal, please provide a written proposal to cure the mortgage default request so that we may forward to our client for their consideration. We will immediately forward your request to the lender for consideration and advice of both the lender and any investor on the mortgage. This process may take some time and the lender may not respond to your proposal.

Property under Agreement of Sale:

        If your property is under an Agreement of Sale that will result in full payoff of the mortgage held by our client, please email or fax to us a copy of the following:

        A copy of a bona-fide, arms length Agreement of Sale signed by buyers and sellers and the Mortgage Commitment for the new purchaser or, if a cash transaction, bank statements for the buyer evidencing the immediate availability of funds and your written proposal and request.

Responses to your Proposal:

        We cannot guarantee that the lender will respond to your workout request. If our client (the lender), is interested in your proposal, they generally will contact you directly to discuss options. If a Sheriff's Sale is scheduled in the next thirty (30) days, we urge you to explore all alternatives now; do not wait until the last moment when your options may be limited.

Borrower Authorization Needs:

        If you are not the homeowner, we CANNOT release any information to you without the homeowner's written consent. For a form of borrow authorization you may user the attached or your own format.   Authorization Borrower Form

        If you are an attorney, a letter of representation from you on your firm's letterhead is sufficient authorization. Please include your attorney identification number.

IMPORTANT NOTICE:

        We are not authorized to stop or hold an action of foreclosure or remove a property from the sheriff's sale without our client's permission. We strongly advise you to contact your own legal counsel now to discuss other options in the event that our client denies the requests or does not respond to your requests prior to the Sheriff's Sale.
